TERMS & CONDITIONS

The following terms and conditions will set forth an agreement between the Provider (Selfie Snaps Limited) and the customer for the hire of the photo booth. These Terms and Conditions set forth the full, written intention of both parties and supersede all other written and/or oral agreements between the parties.

Bookings

1.1 The customer’s booking is not confirmed until the customer receives a booking confirmation letter or email from the Provider (after receipt of deposit and signed booking contract).

1.2 By placing an order with the Provider either verbally or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all the Provider’s terms and conditions of hire.

1.3 In the event that the Provider is not ready to commence at the agreed time due to the Provider’s fault, then the Provider will still operate the agreed hire period by extending the finishing time of the hire (venue permitting). In the event that the hire does not start at the agreed time, as setup has been delayed due to any unforeseen circumstances that are no fault of the Provider, then the hire will still end as per the agreed time on booking form. In the event that the Provider has set up in time but the hire does not start at the agreed time due to over running of previous activities by the customer or venue, the hire will still end as per the agreed time on booking form.

1.4 The Provider cannot be held responsible for any circumstances that may prevent the Provider from attending the event; these may include but are not limited to severe weather conditions, traffic delays, breakdown of our vehicles, sickness or equipment failure. In the case that the Provider cannot attend or fulfil the hire due to events beyond the Provider’s control the Provider will contact the customer or the venue as soon as possible. In these instances the Provider’s liability will be limited to refunding all of monies paid.

1.5 The Provider agrees to have a Photo Booth operational for a minimum of 80% during this period; operations may need to be interrupted for maintenance of the Photo Booth.

Prices, Deposit & Balance Payments

2.1 All hires are subject to a deposit of at least £150, required at time of booking, via online banking (Deposit is non-refundable except due to cancellation by the Provider).

2.2 The remaining balance to be paid in full and cleared at least 7 days prior to the event start date. If the customer uses the equipment for a time period in excess of the service period agreed, the extra rental time will be billed to the operator at £100 per extra hour or part hour and must be paid before additional hours are provided.

2.3 The Provider reserves the right to charge interest on all overdue accounts at 2% above its’ banker’s current interest rate

Cancellations and Date Changes by the Customer

3.1 Any cancelled order is subject to the following cancellation charges:

Within 8 weeks prior to event 20% of order value

Within 6 weeks prior to event 50% of order value

Within 4 weeks prior to event 75% of order value

Within 2 weeks prior to event 100% of order value

3.2 Any request for a date change must be made in writing at least thirty days in advance of the original event date. Change is subject to photo booth availability, and receipt of a new booking contract. If there is no availability for the alternate date, the deposit shall be forfeited and event cancelled subject to charges in 3.1. Any cancellation will forfeit any deposit payment made. The customer’s deposit is non-refundable however the Provider will move the hire date if required and if possible. The final payment is non-refundable unless The Provider does not provide a photo booth hire for the customer. If the venue has been changed, The Provider must be notified 4 weeks prior to the event date and an additional surcharge may be implemented if it is outside the Provider’s working area.

Equipment

4.1 The Provider reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.

4.2 All sizes quoted are approximate

4.3 All equipment remains the property of the Provider at all times.

4.4 The Provider reserves the right to amend or alter any product specifications without prior notice.

Site Location, Facilities & Conduct

5.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once set up. The customer will ensure there is sufficient space at the venue to set up the photo booth (8 feet long by 6 feet wide). The customer is responsible for ensuring that there is a power socket and power within 6 feet of the booth.

5.2 The customer ensures that they have obtained permission at the venue to use the photo booth.

5.3 The customer will inform the Provider of any circumstances that would make setting the booth up more demanding, including going upstairs, long distances from unloading area to venue etc. A set period of time is allocated for setting up the photo booth and related equipment at the venue which is included within the price, but if there are any complications that are not made known to the Provider beforehand then this will come out of the run time.

5.4 The customer is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.

5.5 The Provider reserves the right to cease operation and remove hired equipment from the site if at any time a representative of the Provider feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the Provider.

5.6 The Provider reserves the right to refuse guests admission into the photo booth if the Provider’s staff feels they are too unruly.

Uploads and Facebook

6.1 All live Uploads and live Facebook Uploads are subject to a stable Wi-Fi connection. The Provider cannot be held responsible for the quality of the Wi-Fi connection at the venue. If live uploads are not possible the event will be uploaded within the next 3 days unless permission is denied in writing.

6.2 The video messaging, email, marryoke, Facebook upload, green screen and digital props are optional extras to the photo booth hire and if for any reason the additions are not working or unavailable the customer is not entitled to a refund..

Liability & Insurance

7.1 The customer agrees to cover the Provider for any damage or theft of the Provider’s equipment whilst on hire.

7.2 The Provider accepts no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.

All other terms and conditions

8.1 The Provider may use any of the photographs from the event for suitable means; this includes but is not limited to advertising and promotional material either in print or on the internet. Attending the event would mean the customer agrees and permission has been granted to do so by the customer and guests, except where permission is denied in advance in writing.

8.2 If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.

8.3 This is the entire agreement and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, the customer agrees to solve any arguments via arbitration.

8.4 In the event that The Provider is unable to supply a working photo booth for at least 80% of the Service Period, the customer shall be refunded a pro-rata amount based on the amount of service received.

8.5 If the printer fails to print out photos on site The Provider will offer to send all guests prints free of charge with free postage. If no service is received, The Provider’s maximum liability will be the return of all payments received from the customer.

8.6 The Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
